After Global Expertise Wafer Division, Ltd. (GEWD), a wholly owned subsidiary of Solar-Fabrik AG, Freiburg, had secured in September 2007 the first delivery tranche under a polycrystalline silicon contract with Hoku Materials , Inc. (Hoku) by opening a cash-collateralized US$ 25 million letter of credit for the agreed upon volumes and prices, the contracting parties have agreed to continue their cooperation on the basis of the first letter of credit. GEWD will not post the second letter of credit. As provided under the terms of the agreement, Hoku has exercised on December 28th, 2007 its contractual option to reduce the total volume of polysilicon to be supplied to the first tranche at the prices agreed upon for this tranche. However, both parties will continue their discussions to possibly increase their allocation from Hoku´s potential future expansions.
